为了确保行业自律和互律机制的顺畅运转，规范鲜香菇出口经营秩序，防止不正当竞争行为，并有效克服国外市场技术性贸易壁垒，以保障我国菇农、生产企业、行业以及国家的利益，并促进产业健康持续发展，鲜香菇出口企业会议达成了以下同行协议：

一、鲜香菇出口行业组织机构

中国食品土畜进出口商会（以下简称“商会”）设立了鲜香菇出口协调机构，其秘书处位于茶土部。

二、鲜香菇出口同行协议价制订与调整程序

在充分征求会员企业意见的基础上，协调组制定并调整鲜香菇出口同行协议价（附件a），并由协调组会员大会（或通过通讯形式）审议后执行。

三、申报预核签章有关手续

（一）审核内容：1. 出口合同中与价格条款相关的项目；2. 交纳鲜香菇输出自筹行业发展资金银行回执；3. 交纳商会签章服务工作工本费银行回执。

（二）申请和办理：

出口企业在报关前应将复印件邮寄或送达商会。对于申请加急办理的合同，可采用传真方式提供材料。

商会在收到全部申报材料并经审核符合“鮮香菇輸出同業協議價”的情况后，将加盖“輸出價格預核專用章”。同时应在收到材料后的两個工作日内将签章后的合同寄送申報企業。

对于不符合要求的合同，商會將以傳真形式通知申報企業，並不予签章。

在海關辦理輸出報關時，由於有「輸出價格預核專用章」加盖，即可放行。未經預核簽章的手續則被拒絕。

五、违规处理机制

Fresh Mushroom Export Coordination Committee's Supervisory Board shall be responsible for investigating violations by export enterprises of the Fresh Mushroom Export Coordination Committee's regulations.

2004年11月24日Fresh Mushroom Export Coordination Committee meeting passed the following resolution on violation recognition and penalties:

Low-priced exports of fresh mushrooms below industry agreement prices.

Use of unfair competitive methods to win over customers (prices lower than 8% below those offered by competing companies).

Fraudulent or falsified transactions in sales contracts.

Failure to record sales contracts at the Secretariat or exporting fresh mushrooms with incorrect product numbers.

Refusal to provide required documents or cooperate with investigations by the Supervisory Board.

The committee will establish a system for managing self-funded funds for the mushroom export industry (see Annex B). The interpretation rights belong to the Fresh Mushroom Export Coordination Committee Council.
